Corporate Loyalty Program Terms and Conditions
The Corporate Loyalty Program will begin on July 2, 2008 and companies will begin earning credits on eligible purchases of promotional products purchased from Maraca Canada on or after that date.
No Club to Join, No Forms to Fill Out – Companies are automatically eligible to earn Program Credits unless they opt out or if you are ineligible to participate in the program due to company policies and/or procedures.
By participating in the Corporate Loyalty Program, the company acknowledges and agrees that they are eligible to participate in the Corporate Loyalty Program and to be bound by these terms and conditions.
Corporate Loyalty Program Credits will be earned on eligible purchases made by the company on promotion products, and only promotional products, purchased from Maraca Canada excluding purchases made as part of contracted Promotional Merchandise Program, tender, RFP or any other products or purchases that may, at Maraca Canada’s sole discretion, from time to time be excluded from the Corporate Loyalty Program.
When a purchase is made, the total amount of that purchase, less shipping and taxes, will be used to calculate the amount of Program Credits that will be earned as Pending Credits. Pending Credits will remain as pending until that purchase is completed, received by the company and paid for in full within the payment terms as stipulated on that purchases’ invoice. When that purchase is completed and has been paid in full within the required period of time the Pending Credits will then be available to be applied towards future purchases.
Cancelled or returned purchases (or parts thereof) are ineligible for the Corporate Loyalty Program and will not earn Program Credits. Any Program Credits that were awarded for a purchase prior to the return or cancelation of that purchase (or part thereof) will be deemed ineligible for redemption.
Corporate Loyalty Program Credits cannot be used as credit against any outstanding account balance for purchases made prior to the start of the program.
Corporate Loyalty Program Credits are valid for redemption only within the calendar year following the month that they were accumulated in and may only be redeemed against the net total less applicable taxes on any future promotional product purchase(s).
The Corporate Loyalty Program cannot be combined with any other offer – no more than one promotional offer may be used per order.
Effective July 2, 2008 Corporate Loyalty Program Credits will be earned on every dollar spent on promotional products excluding applicable shipping and taxes as per rates shown on www.maraca.com. Maraca Canada reserves the right to make changes to the rates at any time without prior notice and any such changes and the effective date of such changes will be current as shown at www.maraca.com.
Corporate Loyalty Program Credits have no cash value and cannot be exchanged for cash– credits can only be redeemed by applying the value as a credit against future qualified purchases - are not transferable, cannot be sold or purchased and may not be exchanged, gifted, bartered, mortgaged or made subject to any security interest or charge.
The Corporate Loyalty Program is subject to change and or cancellation without notice.
Companies may be required to pay additional fees such as, but not limited to, deposits, booking fees, setup charges, artwork charges, taxes, and other costs. All Corporate Loyalty Program Credit totals, as shown on the purchases’ invoice, will be deemed to be correct, unless otherwise determined by Maraca Canada. Discrepancies must be addressed with Maraca Canada within thirty (30) days of the date the discrepancy occurred. Maraca Canada is not responsible for any errors or omissions with regard to the Corporate Loyalty Program and is also not responsible for any lost, unused or unauthorized use of Corporate Loyalty Program Credits.
Maraca Canada will not be liable or responsible in any manner for any tax consequences which may arise from any participation in the Corporate Loyalty Program and/or and credits earned from the program.
The Corporate Loyalty Program is void where prohibited by law.
Maraca Canada reserves the right to close any Corporate Loyalty Program account that has been inactive for twelve (12) consecutive months, and all accumulated Corporate Loyalty Program credits will be forfeited.
Maraca Canada reserves the right to modify or cancel the Corporate Loyalty Program at any time, without advance notice. In the event of discontinuing or cancelling the Corporate Loyalty Program, Maraca Canada will attempt to provide at least thirty (30) days notice to you, within which you may not earn any additional Program Credits but you may redeem outstanding Corporate Loyalty Program Credits.
Any failure to comply with any of these terms and conditions or any violation, fraud or abuse of the Corporate Loyalty Program or of the Corporate Loyalty Program credits may result in forfeiture of all credits and possible termination of your participation in the Corporate Loyalty Program without compensation as deemed appropriate and necessary by Maraca Canada.
