Buyer Incentive Program Terms and Conditions

The Buyer Incentive Program will begin on July 2, 2008 and buyers will begin accruing points on eligible purchases of promotional products purchased from Maraca Canada on or after that date.

No Club to Join, No Forms to Fill Out – You are automatically eligible to accrue Reward Points unless you opt out or if you are ineligible to participate in the program due to your company’s policies and/or procedures.

By participating in the Buyer Incentive Program, the buyer acknowledges and agrees that they are eligible to participate in the Buyer Incentive Program and to be bound by these terms and conditions.

Buyer Incentive Program Reward Points will be awarded on eligible purchases made by the buyer on promotional products, and only promotional products, purchased from Maraca Canada excluding purchases made as part of contracted Promotional Merchandise Program, tenders, RFPs or any other products or purchases that may, at Maraca Canada’s sole discretion, from time to time be excluded from the Buyer Incentive Program.

When a purchase is made, the total amount of that purchase, less shipping and taxes, will be used to calculate the amount of Reward Points that will be accrued as Pending Reward Points. Pending Reward Points will remain as pending until that purchase is completed, received by you and paid for in full within the payment terms stipulated on that purchases’ invoice. When that purchase is completed and has been paid in full within the required period of time the Pending Reward Points will then be available for redemption.

Cancelled or returned purchases (or parts thereof) are ineligible for the Buyer Incentive Program and will not earn Reward Points. Any Reward Points that were awarded for a purchase prior to the return or cancelation of that purchase (or part thereof) will be deemed ineligible for redemption.

No more than 50,000 Buyer Incentive Program Reward Points will be awarded on any single purchase transaction unless otherwise agreed in advance of said purchase by Maraca Canada.

Points are valid for redemption only within the 12 months following the month that they were accumulated in.

Buyer Incentive Program Reward Points are not transferable from one buyer to another buyer and may only be accrued on purchases made by that buyer.

Effective July 2, 2008 Buyer Incentive Program Reward Points will be awarded at a rate of one Reward Point for every dollar spent excluding applicable shipping and taxes. Maraca Canada reserves the right to make changes to the above rate at any time without prior notice and any such changes and the effective date of such changes will be current as shown at www.maraca.com.

Buyer Incentive Program Reward Points have no cash value and cannot be exchanged for cash, cannot be sold, purchased, exchanged, gifted, bartered, mortgaged or made subject to any security interest or charge or combined with any program or special.

The Buyer Incentive Program is subject to change and or cancellation without notice.

To redeem Buyer Incentive Program Reward Points you must have accumulated sufficient Reward Points required for the reward item of your choice. You may only redeem your Reward Points for items currently featured in Maraca Canada’s Buyer Incentive Program at the point levels indicated on www.maraca.com. Buyer Incentive Program reward items and the required Reward Point levels for redemption are subject to change without prior notice and will be current as shown at www.maraca.com.
When redeeming your Buyer Incentive Program Reward Points, the buyer’s Reward Points total will be reduced by the specified number of Reward Points required for the reward item being redeemed.

Maraca Canada will pay all applicable taxes on the reward items redeemed. You may be required to pay additional fees such as, but not limited to, shipping fees, deposits, activation, configuration, installation, programming or setup fees, membership, program or subscription fees and other costs.

Maraca Canada assumes no responsibility for any loss, damage, defect, injury, death or expense relating to the Buyer Incentive Program and/or any reward item redeemed through the Buyer Incentive Program.

Buyer Incentive Program reward items redeemed as part of the Buyer Incentive Program are subject to the conditions of that reward item’s manufacturer’s warranty.

All Buyer Incentive Program Reward Point totals, as shown on the purchase’s invoice, will be deemed to be correct, unless otherwise determined by Maraca Canada. Discrepancies must be addressed with Maraca Canada within thirty (30) days of the date the discrepancy occurred. Maraca Canada is not responsible for any errors or omissions with regard to the Buyer Incentive Program and is also not responsible for any lost, unused or unauthorized use of Buyer Incentive Program Reward Points.

You must notify Maraca Canada immediately if you leave your current company and/or no longer have the authority to buy for that company.

Maraca Canada will not be liable or responsible in any manner for any tax consequences which may arise from any participation in the Buyer Incentive Program and/or and redemptions from the program.

The Buyer Incentive Program is void where prohibited by law.

Maraca Canada reserves the right to close any Buyer Incentive Reward Program account that has been inactive for twelve (12) consecutive months, and all accumulated Buyer Incentive Reward Program Points will be forfeited.

Maraca Canada reserves the right to modify or cancel the Buyer Incentive Program at any time, without advance notice. In the event of discontinuing or cancelling the Buyer Incentive Program, Maraca Canada will attempt to provide at least thirty (30) days notice to you, within which you may not accrue any additional reward points but you may redeem any outstanding Buyer Incentive Program Reward Points.

Any failure to comply with any of these terms and conditions or any violation, fraud or abuse of the Buyer Incentive Program or of the Buyer Incentive Program Reward Points may result in forfeiture of all Reward Points and possible termination of your participation in the Buyer Incentive Reward Program without compensation as deemed appropriate and necessary by Maraca Canada.
